Terms of Service

Effective and last updated September 17, 2026

These Terms of Service ("Terms") are an agreement between you and Proshark, a business based in California, United States, operating the VXSentry service ("VXSentry," "we," "us," or "our"). Please read them carefully.

1. Acceptance and eligibility

By creating an account, clicking to accept, purchasing credits, or using VXSentry, you agree to these Terms and our Privacy Policy. If you use VXSentry for an organization, you represent that you have authority to bind it; "you" then includes that organization.

You must be at least 18 and legally able to enter a contract. If you do not agree, do not use the service.

2. Accounts

Provide accurate, current account information and keep your credentials confidential. You are responsible for activity under your account except to the extent caused by our breach of these Terms or nonwaivable law. Notify inquiries@vxsentry.com promptly if you suspect unauthorized access. Do not share, sell, impersonate, or create accounts to evade limits or enforcement.

3. The service and its limits

VXSentry analyzes email addresses and lists using technical and risk signals and returns classifications, scores, diagnostics, and suggested actions. A check may contact DNS infrastructure and recipient mail servers with SMTP envelope commands, but it does not send an email message or submit message content during the check.

Results are point-in-time risk assessments, not facts that remain true indefinitely. Mail providers can hide status, throttle or block probes, accept all recipients, change behavior, or return ambiguous responses. A DELIVERABLE result does not guarantee delivery, inbox placement, or engagement. An UNKNOWN result is inconclusive and must not be treated as deliverable. Catch-all, risky, high-risk, and other labels require your independent judgment.

Optional AI summaries explain aggregate statistics and do not make or alter verification decisions. VXSentry does not provide legal, compliance, or deliverability advice, and results are not a substitute for consent records, suppression practices, or professional advice.

The AI help assistant provides automated guidance and may make mistakes. It cannot inspect your private account records, change credits, issue refunds, or guarantee a resolution. Check important information against the applicable service pages or ask our support team. A support email is submitted only when you review and confirm the support form; an AI reply alone is not evidence that a request was sent or received. Do not submit passwords, secret keys, card details, or unnecessary personal data.

4. Your data and responsibilities

You retain your rights in data you upload. You represent that you have all rights, notices, permissions, authority, and lawful bases needed to collect, upload, disclose, and instruct us to process it. You must honor applicable privacy, marketing, anti-spam, consumer-protection, and suppression requirements.

Verification is a technical check only. It does not establish or imply that a recipient consented to marketing, that contacting the recipient is lawful, or that an address belongs to the person you expect. You are solely responsible for deciding whether and how to contact anyone and for the content, frequency, and recipients of your communications.

Avoid uploading unnecessary fields or sensitive personal information. File names may be sent to OpenAI with aggregate statistics if you use an available AI-summary feature, so do not put confidential or personal information in file names unless appropriate.

5. Acceptable use

You may not use VXSentry to:

  • support spam, harassment, stalking, fraud, phishing, threats, or unlawful surveillance;
  • process scraped, stolen, purchased, or other data you are not authorized to use;
  • violate privacy, anti-spam, intellectual-property, or other applicable law or another person's rights;
  • probe addresses to facilitate credential attacks, account discovery, discrimination, or harm;
  • introduce malware, disrupt the service, bypass safeguards or rate limits, or gain unauthorized access;
  • reverse engineer or copy the service except where such a restriction is prohibited by law; or
  • resell or provide access to VXSentry except under a separate written agreement.

We may investigate suspected misuse and apply reasonable technical and abuse-prevention rate limits.

6. Lifetime free check

Each verified, active account can check up to 10 unique email addresses for free over the lifetime of that account, submitted together or in smaller batches. Previously completed free checks count toward this total. Viewing or resubmitting a saved result does not use another check. An UNKNOWN or other completed result consumes one check because the technical check was performed, even if it was inconclusive. We may permit a retry after an eligible technical failure, subject to cooldowns, failure limits, and abuse-prevention rate limits. Creating another account to obtain another allowance is prohibited.

7. Credits, payments, and refunds

VXSentry currently offers one-time, pay-as-you-go credit purchases, not subscriptions or automatic renewals. Available packages, credit amounts, currency, and total price are shown at purchase and may change for future purchases. Checkout is hosted by Square. Credits are added only after payment is confirmed.

Credits are a limited right to use eligible VXSentry features. They are not cash, stored value, or property; have no cash value; and may not be transferred, resold, or redeemed for money. Credits are debited when a job begins. The service may return credits for unprocessed or failed rows according to its then-current technical rules, but no particular deliverability outcome earns a credit refund.

Completed credit-pack purchases are nonrefundable except where required by law or expressly agreed by us. If you believe a charge is incorrect or a confirmed payment did not add the stated credits, email inquiries@vxsentry.com with the account email, date, amount, and Square receipt or order reference. We will investigate and may request reasonable verification. Nothing here limits chargeback or refund rights that cannot lawfully be waived.

8. Ownership and licenses

You grant Proshark a limited, nonexclusive license to host, copy, parse, transmit, analyze, and otherwise process your uploads and instructions only as reasonably necessary to provide, secure, troubleshoot, and support VXSentry, comply with law, and enforce these Terms. This license lasts while the relevant data is retained for those purposes and does not transfer ownership of your data to us.

Proshark and its licensors own VXSentry's software, design, brand, documentation, and other service materials. Subject to these Terms, we give you a limited, revocable, nonexclusive, nontransferable right to use the service for your internal lawful purposes. Feedback may be used without restriction or payment, provided we do not identify you publicly without permission.

9. Privacy

Our Privacy Policy explains how we handle account, upload, result, transaction, and technical information, including our role as a service provider or processor for customer-uploaded personal information. You are responsible for providing legally required notices to people whose information you submit.

10. Availability and service changes

Unless we separately agree in writing, VXSentry has no service-level or uptime commitment. Maintenance, provider outages, mail-server policies, network restrictions, and security events may interrupt or limit checks. We may change, add, or discontinue features when reasonably necessary, while respecting paid rights and nonwaivable law. Export important results you need; the service is not intended as permanent archival storage.

11. Suspension and termination

You may stop using VXSentry at any time and may request account closure by email. Account closure is not an automatic promise to erase every record; retention and deletion are described in the Privacy Policy.

We may proportionately restrict or suspend access to prevent immediate harm, protect the service, comply with law, address nonpayment, or investigate a suspected violation. We may terminate access for a material or repeated breach, unlawful or abusive use, or when continuing the service is no longer reasonably practicable. Where circumstances permit, we will provide notice and a reasonable opportunity to cure or export data. Immediate action may be necessary for fraud, security threats, legal requirements, or risk to others.

Terms that by nature should survive—including payment obligations, ownership, disclaimers, liability limits, and dispute provisions—survive termination.

12. Disclaimers

To the maximum extent permitted by law, VXSentry is provided "as is" and "as available." Proshark disclaims implied warranties of merchantability, fitness for a particular purpose, noninfringement, and any warranties arising from course of dealing or usage. We do not warrant uninterrupted or error-free operation, that every address can be conclusively classified, or that results will achieve any delivery, inbox-placement, revenue, reputation, or compliance outcome.

These disclaimers do not exclude warranties or consumer rights that applicable law does not allow to be excluded.

13. Limitation of liability

To the maximum extent permitted by law, neither Proshark nor its suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunity, or data, arising from VXSentry, even if advised that such loss was possible.

To the maximum extent permitted by law, Proshark's total aggregate liability arising out of or relating to VXSentry or these Terms will not exceed the greater of (a) the fees you paid to Proshark for VXSentry during the 12 months before the event giving rise to the claim or (b) US $100.

These exclusions and cap do not apply to Proshark's fraud or willful misconduct, or to liability, remedies, or rights that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions, so they may not apply to you.

14. Governing law and disputes

California law governs these Terms, without regard to conflict-of-law rules. Courts with lawful jurisdiction in California may hear disputes. However, this choice does not deprive a consumer of mandatory protections or the right to bring proceedings in a forum that cannot lawfully be waived under the law of the consumer's home jurisdiction.

Before filing a claim, we encourage you to contact us and describe the issue so both sides can try to resolve it informally. These Terms do not require arbitration and do not waive any right to participate in a class or representative action that is otherwise available.

15. General terms and contact

We may update these Terms when the service, law, or our business changes. We will post the revised Terms, update the date above, and provide additional notice of material changes when appropriate or legally required. Changes apply prospectively from their stated effective date. Continued use after they take effect constitutes acceptance where allowed by law.

If part of these Terms is unenforceable, it will be limited to the minimum extent necessary and the rest remains effective. Failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or transfer of the service, subject to applicable law. These Terms and incorporated policies are the entire agreement about VXSentry unless we sign a separate written agreement with you.
